Acceptance of Terms
By accessing or using Sparrow ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including hunt organizers and players.
Description of Service
Sparrow is a GPS scavenger hunt platform that lets organizers design and publish location-based hunts with waypoints, QR check-ins, and live leaderboards, and lets players discover and complete those hunts on iOS, Android, and the web.
Accounts and Access
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access. Accounts are non-transferable.
Organizer Responsibilities
If you create hunts, you are responsible for: obtaining any permits required to direct participants to a physical location; ensuring waypoints are safe, accessible, and legal to visit; and ensuring your hunt content does not violate any law or these terms. You retain ownership of the hunts you create; by publishing them you grant Sparrow a license to host, display, and deliver them to players.
Acceptable Use
You agree not to: use the Service for unlawful purposes; upload content that is harassing, defamatory, or infringes third-party rights; attempt to reverse-engineer or interfere with the Service; create hunts that direct participants to private property without permission; or use automated tools to scrape or overload the platform.
Intellectual Property
All platform software, design, and branding — including the Sparrow name, the X-mark, and the Wordmark — are owned by or licensed to Sparrow. Nothing in these terms transfers any intellectual property rights to you. Your hunt content remains yours, subject to the hosting license described above.
Disclaimers
The Service is provided "as is" without warranty of any kind. Sparrow does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. Outdoor activities carry inherent risk; Sparrow is not responsible for injury, loss, or damage arising from participation in a hunt.
Limitation of Liability
To the maximum extent permitted by law, Sparrow's total liability for any claim arising out of or relating to these terms or your use of the Service is limited to the greater of (a) the fees you paid to Sparrow in the twelve months preceding the claim, or (b) one hundred US dollars. Sparrow is not liable for indirect, incidental, or consequential damages.
Termination
We may suspend or terminate your account for material breach of these terms, with or without notice. You may delete your account at any time from your profile settings. Upon termination, your published hunts will be unpublished and your personal data handled per our Privacy Policy.
Changes to Terms
We may revise these terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
